1.1 PinaSakay MegaApp (“PinaSakay,” “we,” “our,” or “us”) is committed to protecting the privacy and personal data of all individuals and entities who register as Service Providers on our platform.

1.2 This Privacy Policy explains how we collect, use, store, share, and protect your personal data, and outlines your rights under the Philippine Data Privacy Act of 2012 (RA 10173) and applicable international standards such as the GDPR and ISO/IEC 27701.

1.3 By registering as a Service Provider, you confirm that you have read, understood, and agreed to this Privacy Policy.

2. Scope

2.1 This policy applies to all persons and businesses providing services through the PinaSakay MegaApp, including but not limited to:

  • 2.1.1 Ride-hailing drivers (motorcycle, tricycle, 4-wheeler)
  • 2.1.2 Delivery couriers (parcel, food, goods)
  • 2.1.3 On-demand professionals (home repair, beauty, technical, tutoring, etc.)
  • 2.1.4 Rental providers (vehicles, equipment, spaces)
  • 2.1.5 Travel and tour operators or guides
  • 2.1.6 Merchant partners and vendors

3. Definitions

3.1 Personal Data – Any information from which your identity is apparent or can reasonably be ascertained.

3.2 Sensitive Personal Information – Data classified as sensitive under RA 10173, including government-issued IDs, financial details, and health-related data.

3.3 Processing – Any operation performed upon personal data, such as collection, recording, storage, updating, retrieval, use, sharing, or deletion.

3.4 Data Subject – The individual or entity whose personal data is processed (you, the Service Provider).

3.5 Data Protection Officer (DPO) – The person designated to ensure compliance with privacy laws and regulations.

4.4 Service & Operational Data

  • 4.5.1 Device and OS information

5. Purpose of Processing

We process your personal data for registration, verification, service delivery, payments, customer communication, fraud prevention, legal compliance, operational updates, and optional marketing based on contract performance, legal obligation, legitimate interest, or consent.

6. Data Sharing & Disclosure

6.1 We may share your data with customers, third-party service providers, government agencies, law enforcement, and during corporate transactions where required.

6.2 We do not sell your personal data to advertisers.

7. Data Retention

7.1 Personal data is retained while your account is active and for at least five (5) years after termination.

7.2 After retention, data is securely deleted or anonymized.

10. Location Data, Transfers, Marketing & Updates
